RK ADLER & Associates, PLLC (“RK ADLER,” “we,” “us,” or “our”) is a New York law firm based in Manhattan. This Privacy Policy explains how we collect, use, and disclose personal information through www.rkadler.law and in connection with SIGNAL by RK ADLER, our other publications, events, and related business communications. It also explains your choices concerning that information.
“Personal information” means information that identifies, relates to, or can reasonably be linked to an individual. Our handling of information received in connection with legal services remains subject to applicable duties of confidentiality and other professional obligations, as explained below.
1. Information We Collect
Information you provide. We collect information you provide when you subscribe to a publication, submit an inquiry, register for an event, or otherwise communicate with us. This may include your name, email address, telephone number, mailing address, company or organization, professional title, areas of interest, communication preferences, and the information contained in your correspondence.
Information from other sources. We may receive contact and professional information through introductions, referrals, events, existing professional relationships, and publicly available sources. We use information from these sources only as permitted by applicable law and consistent with your communication preferences.
Technical and usage information. When you visit our website or interact with our electronic communications, we and our service providers may collect information including your IP address, browser and device information, referring pages, pages viewed, dates and times of access, and interactions with website features. Email delivery and engagement information may include delivery status, email opens, and links clicked.
Please do not provide Social Security numbers, financial account credentials, medical information, or other sensitive personal information through general website or subscription forms.
2. How We Use Information
We use personal information for the following purposes:
- Responding to inquiries, evaluating potential engagements, conducting conflicts checks, and maintaining professional relationships.
- Administering subscriptions and sending SIGNAL, articles, newsletters, legal and business updates, firm announcements, invitations, and other informational or promotional communications about RK ADLER and our services.
- Managing events, registrations, and related communications.
- Understanding readership and website activity, tailoring publications to professional interests and stated preferences, and improving our content and services.
- Operating, maintaining, and protecting our website, communications systems, and business records.
- Complying with legal and professional obligations, preventing misuse or fraud, and establishing, exercising, or defending legal rights.
Where a proposed use requires separate notice or consent, we provide that notice or obtain that consent before proceeding.
3. SIGNAL and Other Communications
When you subscribe to SIGNAL or another firm mailing list, we may use your name, email address, professional information, and preferences to send the publications and other communications described at signup. These may include articles, newsletters, firm news, announcements, invitations, and updates concerning our services.
Where permitted by applicable law, we may also send relevant communications to clients, former clients, referral sources, and other professional contacts. We obtain consent where required and respect applicable restrictions and prior opt-out requests. Visiting our website or submitting a general inquiry does not, by itself, constitute consent to receive marketing communications.
You may unsubscribe from publication and marketing emails at any time by using the unsubscribe link in an email or writing to admin@rkadler.law. You may opt out of all such emails even if we also offer preferences for particular publications. We honor unsubscribe requests promptly and within applicable legal deadlines, without charge.
An unsubscribe request does not prevent us from responding to your inquiries or sending necessary, nonmarketing communications concerning a representation, a transaction, an event for which you registered, or a legal or administrative obligation. We may retain limited information to document and honor your preferences.
4. When We Disclose Information
We do not sell your personal information, rent our mailing lists, or provide subscriber contact information to third parties for their independent marketing purposes.
We may disclose personal information in the following circumstances:
Service providers. We may disclose information to providers supporting website hosting, email delivery, subscription management, analytics, information technology, security, and event administration. Access and use are subject to applicable legal and professional requirements.
Legal and professional obligations. We may disclose information to professional advisers, insurers, courts, regulators, or other recipients when permitted or required by law and reasonably necessary to meet legal obligations, respond to lawful process, address fraud or security incidents, or establish, exercise, or defend legal rights.
Firm transitions. In connection with a proposed or completed merger, reorganization, succession, or transfer of our practice, we may disclose information only to the extent permitted by applicable law and professional obligations, with appropriate protections for confidential information.
Your direction or consent. We may disclose information at your direction or with your consent.
None of these provisions authorizes a disclosure prohibited by our duties to a client, former client, or prospective client.
5. Cookies and Online Tracking
Our website may use cookies and similar technologies to support functionality, maintain security, remember preferences, and understand how visitors use the site. Our electronic communications may use pixels and tracked links to measure delivery and engagement.
Providers of analytics or other third-party features may collect information about your use of those features and, depending on their services and settings, your activities over time and across other websites or online services.
You can manage or delete cookies through your browser settings. Disabling certain cookies may affect website functionality. Blocking remote images in your email application may limit some email-open tracking but does not necessarily prevent measurement of links you click. Where applicable law requires consent or a particular choice mechanism for these technologies, we obtain consent or provide that mechanism.
Our website does not currently respond to browser “Do Not Track” signals. These differ from legally recognized opt-out preference signals, such as Global Privacy Control, which we honor where required by applicable law.
6. Client Confidentiality and Inquiries
Our duties under the New York Rules of Professional Conduct and other applicable law govern information concerning clients, former clients, and prospective clients. Those duties, together with applicable engagement terms, control over any inconsistent provision of this Privacy Policy. This policy is not a request for, or a grant of, consent to disclose privileged or confidential information.
Visiting our website, subscribing to a publication, or contacting us does not, by itself, establish an attorney-client relationship. Please do not send confidential information about a matter through the website unless we have confirmed that it is appropriate to do so and provided instructions for its transmission. Nothing in this policy waives or limits any protection or duty that applies to information we receive from a prospective client.
7. Security and Retention
We use reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, disclosure, alteration, or loss. No system or method of transmission is completely secure.
We retain personal information for as long as reasonably necessary for the purposes described in this policy, taking into account our relationship with you, the nature of the information, applicable legal and professional obligations, and legitimate recordkeeping needs. Certain information may need to be retained for conflicts checks, legal claims, compliance, security, or suppression of future marketing emails, even after a subscription ends or a deletion request is made.
8. Your Choices and Privacy Requests
You may contact admin@rkadler.law to update your contact information or communication preferences, ask about our handling of your information, or submit a privacy request.
Depending on your location and the law applicable to our processing, you may have rights to access, correct, delete, or obtain a portable copy of personal information; restrict or object to certain processing; withdraw consent; or opt out of specified uses or disclosures. These rights are subject to applicable conditions and exceptions, including protections for privileged information, legal obligations, and the rights of others.
We may reasonably verify your identity and, if relevant, the authority of a representative before acting on a privacy request. Ordinary email unsubscribe requests do not require that verification. We respond within the time required by applicable law and explain a denial where required. If applicable law gives you a right to appeal, send your appeal to the same address, identifying the decision you wish us to reconsider. You may also have a right to contact the relevant privacy regulator. We will not unlawfully discriminate or retaliate against you for exercising your rights.
9. Visitors Outside the United States
RK ADLER operates from the United States. Information may be processed in the United States or other jurisdictions where our service providers operate, whose privacy laws may differ from those in your jurisdiction. Where applicable law imposes requirements on international transfers, we comply with those requirements. This policy does not treat your use of the website as consent to processing or transfers that require separate consent.
10. Third-Party Websites and Services
Our website and communications may contain links to third-party websites, publications, platforms, or services. Their collection and use of information are governed by their own privacy policies. We encourage you to review those policies before providing personal information.
11. Changes to This Policy
We may revise this policy to reflect changes in our practices or legal obligations. We will post the revised policy here with an updated effective date and provide additional notice or obtain consent where required by law. A policy update does not, by itself, expand consent previously given or override an existing unsubscribe request.
